As a reminder, the Apple Watch is at the center of a legal dispute in the United States. The International Trade Commission (ITC), responding to a complaint by Masimo, a company specializing in medical devices, has ruled on a patent infringement case. Blood oxygen measurement technology, a key feature of the Apple Watch Series 9 and Apple Watch Ultra 2, is at the heart of the controversy.

As a result, Apple suspended sales and imports of the offending model. The move went into effect on December 21 on their website and three days later in their physical stores in the United States. However, initially, the brand managed to get a temporary suspension of the ban, especially regarding the Apple Watch Series 9 and Ultra 2 models.

But this victory was short-lived. A federal appeals court has rejected Apple’s request that it hopes to keep its watches on the US market while the appeals process plays out. For this reason, The ban on Apple Watch sales has been reinstated.

Apple in legal impasse

Faced with this situation, Apple finds itself in an impasse. There are two main options: either find common ground with Massimo, possibly involving a financial agreement, or proceed to modify the functionality of Apple watches to comply with legal requirements. And it will be a big blow for Apple.
