. This Thursday, the Constitutional Council ruled and ruled that the law that postpones the presidential election until December 15 is unconstitutional. In the same decision, he overturned the President’s order Mackey Cell which canceled the convocation of the electoral body for February 25.

for what The Council of Wise Men based its decision on the principle of legal certainty, Article 103 which stipulates that no one can amend the number and duration of presidential orders. According to him, the postponement of the presidential election violates this abstract article of the constitution which locks in the number and duration of the presidential mandate.

Clearly, by postponing the presidential election till December 15, the President will remain in power beyond his mandate which ends on April 2. An impossible fact, according to the Constitutional Council, because of this lock.

When will Senegalese elect their next president? Regarding the date, the council still assures that it will not be possible to hold the poll on February 25. Hence they invite the competent authorities to organize this election at the earliest.
